Article1
ScopeofApplication
ThisOrdinanceshalldefinetheproperformandcontentofdocumentsrequiredfor
1.thewastemanagementconceptpursuanttoArticle19(1)oftheClosed
SubstanceCycleandWasteManagementAct;
2.thewastebalancesheetpursuanttoArticle20(1)oftheClosed
SubstanceCycleandWasteManagementAct;
itshallalsosetforthexceptionsforcertaintypesofwaste.

FormandContentoftheWasteManagementConceptandWasteBalance
Sheet
Article2
Waste,WasteProductionSites
(1)Anyonewhoisrequiredtoprepareawastemanagementconceptandawaste
balancesheet(personrequiredtoprepareaconcept,personrequiredtopreparean
analysis)shall
1.specifythevarioustypesofwasterequiringspecialsupervision,and/or
ofwasterequiringsupervision,thatheproducesanddeterminethequantities
involvedand
2.specifyhisvariouswasteproductionsites,withrespecttothewastereferredtoin
No.1
inthedocumentsofthewastemanagementconceptandthewastebalancesheet.
(2)ThefollowingInformationshallbegivenforwastepursuanttoparagraph(1)No.1:
1.thecodeofwasteandwastedesignationpursuanttotheOrdinanceonthe
IntroductionoftheEuropeanWasteCatalogue(EAK-Verordnung)of13September
1996(FederalLawGazetteIp.@1428)ortotheOrdinanceonCodificationof
WasteRequiringSpecialSupervision(Bestimmungsverordnungbesonders
überwachungsbedürftigeAbfälle)of10September1996(FederalLawGazetteIp.
1366)ortotheOrdinanceonCodificationofWasteforRecoveryRequiring
Supervision(BestimmungsverordnungüberwachungsbedürftigeAbfällezur
Verwertung)of10September1996(FederalLawGazetteIp.1377);
2.inaddition,inthecaseofwasterecoverytakingplaceoutsideoftheFederal
RepublicofGermany,thecodeofwasteandwastedesignationpursuantto
CommissionDecision94/774/ECof24November1994concerningthestandard
consignmentnotereferredtoinCouncilRegulation259/93/EEConthesupervision
andcontrolofshipmentsofwastewithin,intoandoutoftheEuropeanCommunity
(OJNo.L310,p.70);
3.thequantitiesofthevarioustypesofwastedescribedpursuanttoNos.1or2that
a)havebeenproducedduringthecalendaryearcoveredbythewastebalance
sheetand
b)areexpectedtobeproducedineachofthecalendaryearscoveredbythewaste
managementconcept
ateachwasteproductionsitepursuanttoparagraph(3).
(3)Wasteproductionsitesshallincludeoperatingsites,otherstationaryfacilities,
structures,plotsofLandoranymobiletechnicalfacilitiesthatoperate
independentlyoftheabove.Thespecificationofthewasteproductionsitesshall
includethefollowing
1.theoperationaldesignation;
2.thewasteproducernumber(Erzeugernummer);
3.whereafacilitysubjecttolicensingrequirementswithinthemeaningofArticle4
(1)oftheFederalImmissionControlActisconcerned,therelevantnumberand
columnoftheAnnextotheOrdinanceonInstallationsSubjecttoLicensing,inthe
applicableversion;
4.informationastowhethernotificationpursuanttoArticle11oftheOrdinanceon
theFurnishingofProof(Nachweisverordnung)of10September1996(FederalLaw
GazetteIp.1382)hasbeensubmittedtothecompetentauthority.
(4)Thequantitiesofwastelistedinthewastemanagementconceptandthewaste
balancesheetshallbegivenintonnes.
Article3
DestinationoftheWaste
(1)Inthedocumentsonthewastebalancesheet,thepersonrequiredtopreparean
analysisshalllistthefacilityusedforwasterecoveryordisposal(facility),andthe
recoveryordisposaloperationpursuanttoAnnexIIAorIIBoftheClosed
SubstanceCycleandWasteManagementActthatisusedinthefacility,foreach
typeofwastetobespecifiedpursuanttoArticle2(2)Nos.1and2andforthe
quantityofwastepursuanttoArticle2(2)No.3lettera.Afacilityinwhichwasteis
onlystoredmaybelistedonlyifthewastewasstillbeingstoredinthefacilityatthe
endofthecalendaryearcoveredbythewastebalancesheet.
(2)Wheredifferentfacilitiesordifferentrecoveryordisposaloperationswereusedfor
differentsub-quantitiesofthesametypeofwaste,therelevantdifferentsubquantities
ofthetotalquantityofwasteshallbespecifiedpursuanttoArticle2(2)
No.3lettera,andtheinformationpursuanttoparagraph(1)shallbeprovidedfor
eachsub-quantity.
(3)Thespecificationofthefacilityshallincludethefollowing:
1.thenameoftheoperatorofthefacility;
2.thedesignationandaddressofthefacility;
3.thefacility''swastemanagementnumber;
4.informationastowhether
a)thefacilityisexemptedpursuanttoArticle13oftheOrdinanceonthe
FurnishingofProofof10September1996(FederalLawGazetteIp.1382);
b)thefacilityistheoperator''sownfacilitywithinthemeaningofArticle19(1)
No.4oftheClosedSubstanceCycleandWasteManagementAct;
5.ifrecoveryordisposaltakesplaceinafacilityoutsideoftheFederal
RepublicofGermany,thenameoftheimportingcountrypursuantto
CommissionDecision94/774/ECof24November1994concerningthe
standardconsignmentnotereferredtoinCouncilRegulation259/93/EEConthe
supervisionandcontrolofshipmentsofwastewithin,intoandoutoftheEuropean
Community(OJNo.L310$p.70),intheversionapplicableintheindividualcase.
(4)Inthedocuments-onthewastemanagementconcept,thepersonrequiredtoprepare
aconceptshallspecifytheplanneddestinationforeachtypeofwastetobespecified
pursuanttoArticle2(2)Nos.1and2,andforeachcalendaryearcoveredbythe
wastemanagementconceptpursuanttoparagraphs(1)and(3).Thelistingofa
facilityinwhichwasteisonlytobestoredshallnotbepermissible.Whereno
facilitycanbespecified,thepersonrequiredtoprepareaconceptshallspecifythe
typeoftheplannedfacility.
(5)Wherearecoveryordisposaloperationhasbeencarriedout,orisintendedtobe
carriedout,outsideofafacility,paragraphs(1)through(4)shallapply,withthe
exceptionthatthewastemanagementsiteshallbelistedinsteadofthefacility.
Wherewastehasbeenhandedover,orisintendedtobehandedover,toacollector,
thecollectorshallbespecified;inthewastebalancesheet,thepartyresponsiblefor
wastemanagementshallbespecified.
Article4
TheWasteManagementChain
(1)Thewastemanagementchainshallbedescribedintermsofthedestinationpursuant
toArticle3(4),alongwithsupplementaryinformation.Thepersonrequiredto
prepareaconceptshallincludethefollowingsupplementaryinformationinthe
documentsonthewastemanagementconcept:
1.thesub-quantityofthetotalquantityofwastepursuanttoArticle2(2)No.3letterb
thathastobemanagedinthefacilitiesintendedforthetypeofwastepursuantto
Article3,foreachcalendaryearcoveredbythewastemanagementconcept;
2.thevarioussub-quantitiesofwastethatheintendstotreatasfollowsinthefacilities
intendedforthetypeofwastepursuanttoArticle3:
a)useforenergyrecovery,ortreatforthepurposeofenergyrecovery-,
b)useforsubstancerecycling,ortreatforthepurposeofsubstancerecycling;
c)deposit,ortreatforthepurposeofdeposition;
d)notuseforenergyrecoveryorsubstancerecycling;nottreatforthepurposeof
energyrecoveryorsubstancerecycling;notdepositortreatforthepurposeof
deposition;
eachofthesevarioussub-quantitiesshallbegivenasapercentageofthetotal
quantityofwastewhichthepersonrequiredtoprepareaconcepthasearmarkedfor
thefacilityandtherecoveryordisposaloperationsinquestion,wheresuchpersonis
seekingtoachievethesamepercentagesforthiswaste;
3.forthesub-quantitypursuanttoNo.2letterd,theaimoffinalrecoveryordisposal,
withinformationastotheoperationpursuanttoAnnex11AorIIBoftheClosed
SubstanceCycleandWasteManagementAct;suchaimsmayinclude:
a)deposition;
b)substitutionofnewrawmaterialsbysubstancesrecoveredfromthewaste,
c)useofthewaste''ssubstancepropertiesfortheiroriginalpurposeorforother
purposes,exceptfordirectenergyrecovery;or
d)useforenergyrecovery.
(2)InthecaseofArticle3(5)firstsentence,paragraph(1)shallapply,withthe
exceptionthatthewastemanagementsiteshallbelistedinsteadofthefacility.
Paragraphs(1)Nos.2and3shallnotapplyinthecasecoveredbyArticle3(5)
secondsentence.
Article5
MeasuresandJustifications
(1)Inthedocumentsonthewastemanagementconcept,thepersonrequiredtoprepare
theconceptshallspecify,foreachtypeofwastetobespecifiedpursuanttoArticle2
(2)Nos.1and2,anymeasurestakenandplannedtoavoid,recoveranddisposeof
waste,particularlymeasurestakingintoaccountrequirementspursuanttoArticles4
through6and10through12oftheClosedSubstanceCycleandWaste
ManagementAct.
(2)Inthedocumentsonthewastemanagementconceptandthewastebalancesheet,
thepersonrequiredtoprepareaconceptandananalysisshalljustifyanyneedfor
wastedisposal,forthetypesofwastetobespecifiedpursuanttoArticle2(2)Nos.
1and2andfortheassociatedsub-quantityofwastepursuanttoArticle2(2)No.3,
takingintoaccountthemeasuresspecifiedpursuanttoparagraph(1)foravoidance
andrecovery.
Article6
SiteandFacilityPlanningforPartiesResponsiblefortheirOwnWaste
Management
(1)Ifthepersonrequiredtoprepareaconceptisresponsibleforhisownwaste
management,heshall-inthedocumentsonthewastemanagementconcept,andin
additiontotheplannedwastemanagementchains-indicate,inthespecificationof
thenecessarysiteandfacilityplanningandofthechronologicalsequenceofsuch
planning,whetherand,ifapplicable,whenanyofhisownwastemanagement
facilitiesaretobe
1.putintooperationor
2.takenoutofoperationforanextendedperiod
withinthecalendaryearscoveredbythewastemanagementconcept.Wherea
facilityistogointooperationforthefirsttime,thedateoftherelevantapplication
shallalsobeincluded.
(2)Inthedocumentsonthenecessarysiteandfacilityplanningandforthe
chronologicalsequenceofsuchplanning,thepersonrequiredtoprepareaconcept
shallindicatewhether,andtowhatextent,hisownwastemanagementfacilitieswill
beavailableformanagementofwasteproducedbyhim;thisshallbespecifiedfor
eachcalendaryearcoveredbythewastemanagementconcept.
Article,7
WasteManagementConcept,WasteBalanceSheet
(1)Ifwasteproducedbythepersonrequiredtoprepareaconceptisproducedat
differentsites,awastemanagementconceptshallbepreparedforeachindividual
site.Insuchcases,theDefinitionof"site"giveninArticle2letterkofCouncil
Regulation(EEC)No.1836,of29June1993,allowingvoluntaryparticipationby
companiesintheindustrialsectorinaCommunityeco-managementandaudit
scheme(OJECNo.L168p.1)shallbeappliedmutatismutandis.
(2)Paragraph(1)shallapplymutatismutandistopreparationofwastebalancesheets.
Wheremorethanonewasteproducernumberhasbeenassignedtoasitewithinthe
frameworkofwastesupervision,aseparatewastesub-balancesheetshallbe
preparedforeachwasteproductionsiteassignedtoawasteproducernumber.
Article8
ProperFormfortheWasteManagementConcept
andtheWasteBalanceSheet
(1)Thepersonrequiredtoprepareaconceptandananalysismayusetheforms
pursuanttoAnnex1forspecificationofhiswastemanagementconceptandwaste
balancesheet;nospecificformshallberequiredforanyadditionalspecification
requiredbythisOrdinancewhichisnotcoveredbysuchforms.
(2)Allentriesinthedocumentsonthewastemanagementconceptandthewaste
balancesheetshallbeclearlylegibleandintheGermanlanguage;theyshallbe
printed,typewrittenorwrittenwithaball-pointpenorotherwritinginstrumentthat
makesindeliblemarks.Whereanoriginalentryisrenderedillegible,anoteshallbe
addedindicatingwhethersuchchangeoccurredwhentheentrywasmadeorata
latertime.
(3)Thepersonrequiredtoprepareaconceptandananalysismaypreparethe
documentsindigitalform.Inthiscase,insteadofmakingwrittenentriesinthe
documents,heshallensurethatalltherequiredinformationisproperlysaved.
(4)Thecompetentauthorityandthepersonrequiredtoprepareaconceptandan
analysismayreachtheirownagreementregardingthestructureofthedigital
documentsandthemeansbywhichthedataistobesubmitted.
(5)Thedocumentsonthewastemanagementconceptandthewastebalancesheet,if
preparedindigitalform,shallbeproperlysavedbythepersonrequiredtopreparea
conceptandananalysis,beforebeingsubmittedtothecompetentauthority.
(6)AnenvironmentalstatementwhichhasbeensubmittedpursuanttoCouncil
Regulation(EEC)No.1836,of29June1993,allowingvoluntaryparticipationby
companiesintheindustrialsectorinaCommunityeco-managementandaudit
schemeandacceptedasvalidshallberecognisedasawastemanagementconcept,
orupdatethereof,andasawastebalancesheetiftheeco-audituponwhichthe
environmentalstatementisbasedfulfilstherequirementsofArticles19and20of
theClosedSubstanceCycleandWasteManagementActandofthisOrdinance.
Article9
JointWasteManagementConcept,JointWasteBalanceSheet
(1)Uponapplication,thecompetentauthoritymaypermittwoormorewasteproducers
toprepareajointwastemanagementconceptandapertinentjointwastebalance
sheetif
1.thewastetheyproducecanforthemostpartbeclassifiedwithinthesamecodesof
waste;
2.theyoperateinthesameLand,
3.thewasteinquestionallcomesfromcomparableareasoforiginandeconomic
activities.
Article7secondsentenceshallnotapply.
(2)Wheredifferentwasteproducersparticipateinajointwastemanagementconcept
andajointwastebalancesheet,itshallbespecifiedwhichinformationrefersto
eachindividualwasteproducerandwhichwasteproducersarerequiredtopreparea
conceptandananalysis.

Article10
Exceptions
TheprovisionsofthisOrdinanceshallapplytothewasteslistedinAnnex2column
1,inaccordancewiththeprovisionslaiddowninAnnex2column2.
Article11
EntryintoForce
ThisOrdinanceshallenterintoforceon7October1996.
